Thanks... I have the information..but is not completed....I mean they show us a simple and a basic information but not the specific details..so I just have to wait again for the lettler..the lettler was Sep. 13, 2006. and expired Dec. 6, 2006. I was trying to find the receipt of the 1-140 cause I submit in May 25, 2006 so when called I spoke by the phone with USCIS I was frozen when they told me about the lettler of Sep. 13,(they send us) cause I didn't know... well I have to wait... USCIS have right now this report because the employer never receipt this lettler (none)... the thing is, if they want to approve this application I-140 we hope they will, cause I send again all the documents as the beggining I-140 ETA 750 & attachments, lettler of the employer and the last four taxes of the company..I will see the results... I have faith, and I believe they will fixed..thanks for your support..

My cousin sister told me yesterday that - many are shy. Especially men - men could be the shyest people when it comes to showing up in public.

I need some advice.
I have a PD of November 9th 2001 (EB3).
My 140 and 485 was filed on August 2003.
My 140 was approved in Feb 2004.
I am now retrogressed with the November Visa bulletin showing an April 22nd 2001 PD for EB3.
As we can all see EB3 is move very very slowly and probably will continue this way (I hope I am wrong), while EB2 is already current for my PD.
From my information and some threads on this forum. I believe I have the option of filing for an EB2, while maintaining my current PD.
My Questions:
1. Does it make sense for me to refile in EB2, given my situation? PD Nov 2001 in EB3.
2. Can I apply for EB2 through the same company. (my current company)?
3. What is the process of doing so (EB3 to EB2)? Would I have to refile for labor, 140 and 485, or is their a way I could directly file for I485, since my I140 is approved and I am in the same company.
4. Would the EB2 case be a new case altogether, i.e. not related to my existing EB3 case again providing the fact that I have NOT changed employers?
5. Would I be able to use the experience I have gathered in my current job (5.5 years) in the EB2 conversion.
I will appreciate your help.

You can re-use priority date established on first I-140 for any sub-sequent I-140 filling. As I understand from your post, you have EB3 labor approved and have just filed for I-140 based on it.
Now, parent company wants to transfer you. Generally I would think you should be able to transfer and still have your GC process going if the company indeed is a 'parent company' but seems there is something different here.
As a general rule, as long as your previously approved I-140 remained approved, you can re-use priority date established for that I-140 for any subsequent I-140 petition. The sub-sequent petition can be with any employer, and yes, you would need a new labor to file that new I-140 :)
Try EB1 or EB2 this time :cool:

They should exempt PIOs from this new rules. If back from a vacation and there was an emergency back home ( within 60/90 days?), can't i take my US citizen kid to India ?

While the issues being highlighted may lean towards those being termed as illegal aliens, I wouldn't be so quick to call these organizations as exclusively illegal immigrant interest groups. I filed the Labor Certification since September, 07 and got audited in November, 07. The response was sent to DOL in November, 07. I have not heard anything since then. Also, my H1B visa expired in the early of May, 08. I left US on April 28, 08. I�m very frustrated and depressed, and the lawyer is very unhelpful. I got questions as follows:
1) Should I refile the Labor Certification with my current employer in the new position? How about the audit? Should I request to DOL to withdraw the application first and refile the new one? Will my PD be changed according to the new filing date?
2) What would be the best way about H1B visa? I was out of US for one and a half month during these 6 years of H1B period. I heard that the vacation can be recapped, and I will be able to go back to US in the mid of July, 08 due to the pending PERM application for 365 days. In this case, should I start filing the H1B recapture with the H1 Extension now since my application will be pending for a year by the mid of July, 08 (include one and a half month times out of US). Otherwise, should I wait and start the application in the mid of July, 08?
3) If my Labor Certification is pending again till the end of one year extension (in the case of getting the approval on one year extension), do I have to leave US again?
4) I wonder if I should wait outside US for a year until the early of May, 09. Then, reapply the new 6 year- H1B visa again. Can my current employer do that for me? Would it be the better option comparing to the H1B recapture and H1B extension? In the case of starting the new application, when should I start the application? I heard the new H1B cap usually starts around the early of April and will be filled up within a couple days. Also, I have to wait for one year prior to applying for a new H1B, counting the day that my visa expired. Our AP saga got its final miracle today. (at least I think it’s the final one…) Though my spouse’s and daughter's AP were finally got approved yesterday, the miracle is that TSC has decided to expedite and overnight them, based on a fax from my father-in-law’s doctor.
The very nice lady IO at SF INS office this morning asked for our telephone numbers, and then followed up and called us on our cell phone to confirm that TSC is expediting the APS…..…and overnight-ing them!
Prior to this last miracle the journey was choppy.
We are to leave for India on Dec 26th... ..the APs were e-filed on July 12 to give TSC enough time.
Because nothing seemed to be happening I faxed TSC director (no use), another fax at TSC (not much use), made friends with a TSC rep...(great) got in touch with my Congressman George MIller's office..(fantastic), leading to the approval yesterday and then today comes the icing on the cake… the overnight-ing….
After a season of dryness, it doesn't just rain, it pours!
write to the ombudsman. So much circus for an AP? When you applied 5 months ago!!
oh, and congrats on getting your AP in time for your travel plans.

Yes I am using EAD and AC21 for joining new employer and job title and responsibilities are very similar.
Can I hire a new attorney who can access that information? Or the new company attorney? I think it's going to be impossible to make my present company attorney reveal that detail to me. Since this information is public I think there should be some way to get those details. Please help.
